Will I be forced to pay maintenance even when we have shared care ?
ex left me and our son 4 yrs ago, signing over child benefit etc. over past couple of years due to job changes she has built up number of overnights to 4 due to me being a bit naive and thinking this was best for the child. Given her extra time ,again naively, I signed the child benefit back over to help her out and as soon as she had confirmation of this she has contacted the csa who are now demanding payment . I have statements signed from both parties through solicitors that care is shared and no further financial connections will be made. I have always paid childs clubs etc , holidays, clothes and never taken a penny from her even when I was out of work. But it seems that as she has 4 overnights that I have to pay her money. Is this the case and will they arrest my wages before they go through all the details?

- this is complicated , they wont go into your wages until some form of agreement has been made and then only if you do not stick to the agreement , evrything you pay for the child keep a log , to be honest with you it sounds like all she wants is the money, my partner has not once asked me for money as she believes that spending time with out children is more important and we do share everything down to the cost of the children , maybe i am lucky , i thought that the csa went bust
- You will have to pay maintenance, but the amount you have to pay will depend on certain factors. To reduce the amount you have to pay, you can reduce the overnights to 2 instead of 4. They will not take anything from your wages until the matter is resolved.
- You have been a bit gullable! have you tried an agreement between yourselves? csa encourage this, the time you have care over your kids should affect the amount you pay, bit do pay don't let it build up. i did i owe over £7000. liase with the csa there's lots they can do to help. "good luck"
