If you have student loans in default and move to Canada, can Sallie Mae garnish your wages?
Question posed earlier, please no vulgarity or insults. If you owe student loans and default and move to Canada, can Sallie Mae legally garnish your wages in Canada?

- If you don't have a work visa you will have no wages in Canada. Otherwise, no they cannot.
- Sallie Mae can not garnish you in canada, but they can have a US judgement honored by the Canadian courts. The ycan also have your passport revoked by the State Department, effectively trapping you in Canada. I suggest you work out a repayment schedule with Sallie Mae. It is not worth the aggravation.
- Sally Mae will file a claim in a U.S. court to collect the judgment as a secured creditor. Even if you declare bankruptcy you still can not discharge a student loan. They can not garnish your wages per se. However, in the law there is somthing called full faith and credit, which means a court in another state and country if a treaty is had with the United States, which Canada does have, will enforce the judgement of the US court.
- Student loan people are very easy to work out a deal with. They want to give you the opportunity to pay your loan. I was able to get a 6 month forebearance due to financial problems. There are a lot of repayment options out there. If it is at all possible try to work it out.
- the Canadian courts working with the u.s. courts will have your passport invalidated. you will now be illegal in Canada and up to the immigration laws. the might deport you back to the u.s. for being a illegal alien in that country.
